A man in Columbus, Nebraska, picked the wrong person with whom to play Let’s Make a Deal during an early-morning stop for cigarettes at a gas station and convenience store there.

Platte County District Court Judge Robert Steinke sentenced the man, identified as 26-year-old Juan Lemus to six months in the county jail for attempted delivery of a controlled substance in connection with the December 15 incident.

Lemus, who pleaded no contest to the charge, won’t be needing cancer sticks during his jail term. The Platte County Detention Facility is a smoke-free environment.

The deal gone wrong began around 3:00 AM December 15 when Lemus stopped for cigarettes, lighters and a cigar at Holiday Gas Station at 2903 23rd Street. There was a hitch, however; the Schuyler man was carrying no money.

Lemus “pulled a large plastic bag of what he knew to be marijuana out of his inner coat pocket” and offered to exchange some marijuana for the cigarettes and other merchandise, according to an affidavit filed in the case by Columbus Police Officer Terry Heesacker.

The clerk refused to make the swap numerous times, but Lemus continued to insist that the clerk take the marijuana in trade, Heesacker stated in his affidavit. Lemus eventually offered to give the clerk the “whole bag,” which weighed in at 80 grams (nearly three ounces).

Heesacker said that Lemus left the store when another employee entered, stating that he would return with money. The defendant left and went to a snow drift on the building’s northeast corner, where he buried the bag of weed.

The clerk called the cops to report the incident, with officers arriving to find Lemus pacing back and forth outside the store, Heesacker said. Officers dug into the snow drift and found a “green, leafy substance” in a large plastic bag that had been freshly buried, the officer said.

After the clerk identified the bag and substance as the one that Lemus had used to barter for cigarettes and the other items, Lemus was arrested, Heesacker said.

In the state of Nebraska, attempted delivery of a controlled substance is a Class IV felony, which carries a maximum sentence of five years in prison, a $10,000 fine or both and no minimum sentence.

The judge gave Lemus credit for 26 days already served in the case.
